Abstract

This work of reflection on the law in the face of the performance of the social worker. The Social Service has freedom as a central ethical project and the “option for profes- sional value linked to the process of building a new societal order” (CFESS, 2012, p. 24), while in its praxis with the realization of social rights, with a political position that is consistent with the possibility of human emancipation, in this way, when dealing, especially with the guarantee of rights of the user population, it becomes essential to develop on the right itself, considering the ethical and political direction that has be- come hegemonic. In the profession, therein lies the proposal of this dissertation. This is a bibliographic research, which intends, based on an examination of the law, and the Marxian and Marxist critique of law, to reflect on the limits and possibilities of the social worker’s performance from the Ethics literature of his Code of Ethics in the professional relationship with acting directly with social policies, in the guarantee of new rights that meet with their vilified lives, the most diverse expressions of social interpretation. It is concluded that a contradictory existence is evident between the intentionality posted by the profession and the reality in which the field of law is situated. Indubit is an ob- servation that a task that is proposed, also, if posed or proposed, would not be enough to change the order of construction or other possibility of effecting human emancipation.
