Contratações públicas sustentáveis no judiciário: raízes, tronco robusto e folhagem em crescimento, sob a ótica da Lei n.º 14.133/2021

Abstract

The objective of this dissertation is to analyze the institutionalization of sustainable procurement at the Court of Justice of Roraima, based on Law No. 14,133/2021 and CNJ Resolution No. 400/2021, in the period of 2022-2023. The triple planetary crisis – climate change, biodiversity loss, and pollution – demands immediate global measures to promote a more sustainable future for present and future generations. The research, of a qualitative and descriptive nature, sought to identify advances, challenges, and opportunities for promoting sustainability in the public procurement of the TJRR and to suggest practical actions based on the diagnosis carried out, with a focus on promoting social and environmental justice. Furthermore, this work includes a synthetic overview, analyzing the numbers of sustainable contracts in the state courts of the Legal Amazon during the same period, aligned with the master's degree objective of improving professionals and contributing to a more efficient and humanized Justice System, especially in this region.The methodology encompassed a bibliographic review, documentary analysis, a case study at the TJRR, and the application of questionnaires. The results show that the TJRR is in a promising development phase, driven by the support of senior management and recent regulatory frameworks. However, the consolidation of SPP faces significant barriers, such as the need for greater technical training for civil servants, cultural resistance to new practices, structural challenges of the local market, and the absence of a formally institutionalized sustainability policy. It is concluded that consolidating SPP as a pillar of efficiency and fulfillment of the Judiciary's constitutional mission represents a strategic opportunity. To achieve this, it is fundamental to transform the identified challenges into a concrete action plan that seizes the opportunity to invest in continuous training, to innovate with the formalization of clear policies, and to develop planning and control tools adapted to the Amazonian reality.
