Abstract

The present article aims, through the bibliographic review of laws, jurisprudence, doctrines and statements, the possibility of granting or not the provisional guardianship in the scope of the Special Civil Courts in the absence of legal provision of Law nº 9.099/95. Therefore, the laws of the Special Courts microsystem were studied, as well as those that permeate the theme, the principles, the institute of provisional guardianship and its application in the laws of the Special Courts and, finally, the Statements related to the theme and the national and Tocantins jurisprudence.
