| metadata.dc.description.resumo: | O presente artigo objetiva, através da revisão bibliográfica de leis, jurisprudências, doutrinas e enunciados, a possibilidade de se conceder ou não as tutelas provisórias no âmbito dos Juizados Especiais Cíveis diante da ausência de previsão legal da Lei nº 9.099/95. Para tanto, foram estudadas as leis do microssistema dos Juizados Especiais bem como as que permeiam o tema, os princípios, o instituto das tutelas provisórias e a sua aplicação nas leis dos Juizados Especiais e, finalmente, os Enunciados atinentes ao tema e a jurisprudência nacional e tocantinense. Desse modo, utilizou-se como metodologia o método dedutivo onde pode-se concluir que as tutelas provisórias podem ser utilizadas no âmbito dos Juizados Especiais Cíveis, ainda que incidentalmente |
| Abstract: | The present article aims, through the bibliographic review of laws, jurisprudence, doctrines and statements, the possibility of granting or not the provisional guardianship in the scope of the Special Civil Courts in the absence of legal provision of Law nº 9.099/95. Therefore, the laws of the Special Courts microsystem were studied, as well as those that permeate the theme, the principles, the institute of provisional guardianship and its application in the laws of the Special Courts and, finally, the Statements related to the theme and the national and Tocantins jurisprudence. Thus, the deductive method was used as a methodology, where it can be concluded that provisional injunctions can be used within the scope of Special Civil Courts, even if incidentally |
